Terms of Service

These terms cover how companies and candidates use the Quala platform. By signing up or completing an assessment, you agree to them.

Who we are

Quala is operated by Quala LLC (“Quala”, “we”, “us”). We provide an AI-native engineering work-sample assessment platform that records, scores, and reports on how candidates build software with AI coding agents.

Accepting these terms

By creating a company account, inviting candidates, or completing an assessment, you confirm that you have read and agree to these terms. If you are using Quala on behalf of an organization, you also confirm that you have the authority to bind that organization.

Your account

You are responsible for maintaining the confidentiality of your credentials and for any activity that occurs under your account. Notify us at security@quala.dev if you suspect unauthorized access.

Acceptable use

You agree not to use Quala for anything illegal or harmful. In particular, you must not:

  • attempt to access another customer's data or assessments;
  • scrape, mirror, or otherwise extract our content outside our published APIs;
  • assess candidates without their informed consent;
  • use Quala to make hiring decisions that violate applicable anti-discrimination law; or
  • interfere with the integrity or performance of the platform.

Subscriptions and billing

Paid plans are billed monthly or annually in advance. Fees are non-refundable except where required by law. You can cancel at any time from your account settings — the cancellation takes effect at the end of the current billing period.

Candidate sessions and data

When a candidate completes a Quala assessment, we capture their prompts, code edits, test runs, terminal output, and timing. We process this data on behalf of the inviting company and only for the purpose of producing the candidate report. See our Privacy Policy and Candidate Rights for details.

Intellectual property

You retain ownership of the code your candidates write and of any repositories you upload. We retain ownership of the Quala platform, including the assessment rubrics, scoring models, and report templates. You are granted a non-exclusive, non-transferable license to use the platform during your subscription.

Termination

We may suspend or terminate your account if you materially breach these terms, fail to pay, or use the platform in a way that endangers other customers. On termination we delete your data per our retention schedule unless you request earlier deletion.

Disclaimer and limitation of liability

Quala is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, our total liability for any claim arising out of these terms is limited to the fees you paid us in the twelve months preceding the claim.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Delaware.
